RE: Consortium Program Clients Non-Compliance Addendum
Indiana Testing Inc. (ITI) continues to work closely with all of our consortium program clients. For the betterment of the consortium as a whole, moving forward any consortium program client that is not complying with the consortium rules and regulations for required testing will be fined and removed from the consortium. The consortium program must be in compliance yearly, and clients who are not completing required testing only put other clients at risk. ITI has built a safeguard for these types of issues, however, the issue persists. Moving forward, the below actions will take place if you are not upholding your compliance duties.
If a random selection is not completed within the designated quarter of that selection period, your company will receive a notification stating that your company is out of compliance and will have 90 days to complete testing without penalty. If testing is not completed within the 90-day time period your company will be fined $350.00, removed immediately from the consortium, and marked out of compliance. This information will be placed in your file for any future FMCSA audit requests.
Reminder: Not complying with drug and alcohol rules and regulations 382.305, your company could be subject to fines up to $10,000 or more by the FMCSA. It is extremely important to perform drug and alcohol testing when required by the FMCSA.
